Separation of Powers
Why is the Separation of Powers as important today as it was when the founders wrote the U.S. Constitution?
The Importance of Separation of Powers & Checks and Balances: Published by Seth Connell
The separation of powers is very important in our government today, and it has been important ever since our country was founded. The purpose of “separation of powers is to make sure that no one party or belief can have more control over the government than another” (Connell). The separation of powers is still important today as it was when the founding fathers wrote the Constitution because it makes each branch have its own roles. For example “In the legislative branch, the laws are created, and budgets are passed. The executive branch enforces, or vetoes the laws that the legislative branch creates, and declares states of emergency. The judicial branch determines which laws apply to specific cases; reviews constitutionality of laws, and determine interpretations of laws” (Connell). Having these roles keeps each branch from overpowering each other, and it also keeps each branch focused on their own tasks and not worrying about the other branches. This is how our country’s government has been working ever since the Constitution was written; “but the problem with this system, as any system of government, is human nature” (Connell). That is the only reason why this system hasn’t been working for our government lately, because all people want is power.
Why is the Separation of Powers so Important for the US Government?: By peone Little Rock, Arkansas
The separation of power’s purpose is to make sure that no one person has too much power to abuse and takeover. “History has taught us over and over, that when one person has too much power, there is often abuse of that power” (Peone). If we look back at our history we can see how many leaders had too much power and how they abused it. “For example, the Roman Emperors, at the old European Monarchies, and most recently Stalin and Hitler were all leaders who abused their power” (Peone). This is why the separation of powers is so important, and we use it so it doesn’t happen again. One more reason why we use separation of powers is because it provides the system of checks and balances. “It keeps one branch of government from instituting policy that would be harmful to the US citizenry; without the presidential veto or judicial review we would just be stuck without any way to easily rectify the bad policy” (Peone). Checks and Balances keep each branch of government from getting too much power, so it helps balance out the separation of powers. Each branch of government is equal and it’s that way so that one doesn’t become too powerful and ends up abusing that power.
Why A Separation Of Powers Is Important: by law teachers
Today in the United States separation of powers is a super important concept in our government. Without it our government could take over the country and we would have no say in it. “In order to prevent the abuse of powers, the power of the government should not be left entirely to one body or person; instead it should be separated or divided in some way. Montesquieu went further and divided the power of government into three major functions” (Law Teachers 1). Montesquieu was one of the only people during his time who believed in the separation of powers and his idea actually worked. “Although, a complete separation of power would probably be unworkable as a system of government, would seem presidential, and would also bring the government to a standstill” (Law Teachers 1). Our government works because we have a system of checks and balances where,” It would allow one branch to limit another and to prevent one from becoming supreme, but one branch must not exercise the whole power of another, nor obtain control over another branch, for example the executive should not be able to vote legislative and decide when a new legislation should be elected” (Law Teachers 1). This helps balance out the power between the legislative, executive, and judicial branches. Separation of powers is important because it stops people from abusing their power and taking over our country.
